What is California daily overtime?
California's rule that non-exempt employees earn 1.5× pay after 8 hours in a workday and 2× after 12, plus special rates on the seventh consecutive day of a workweek.
Overtime at 1.5× applies to hours over 8 in a workday, over 40 in a workweek, and the first 8 hours on the seventh consecutive day worked in the workweek. Double time applies to hours over 12 in a workday and over 8 on that seventh day.
Hours already paid as daily overtime are not counted again toward the weekly 40, so the employee is never paid overtime twice for the same hour.
Example: A 13-hour day: 8 h regular, 4 h at 1.5×, 1 h at 2×.
